1. Service Description
SpecTrace is an online platform for iRacing team racing. It provides asynchronous qualifying sessions, leaderboards, telemetry tracking, and season management. The service is operated by Daniel Kappler ("Operator") and accessible at spectrace.app and grid.spectrace.app.
2. Account Requirements
To use SpecTrace, you must create an account. You are responsible for maintaining the confidentiality of your credentials and for all activity under your account. You must provide accurate information and keep it up to date. You must be at least 16 years old to create an account.
3. Acceptable Use
You agree not to:
- Use the service for any unlawful purpose.
- Submit falsified telemetry data or manipulate leaderboard results.
- Attempt to gain unauthorized access to the service or other users' accounts.
- Interfere with or disrupt the service's infrastructure.
- Resell or redistribute the service without permission.
We reserve the right to suspend or terminate accounts that violate these terms.
4. Subscriptions & Pricing
SpecTrace offers both free and paid subscription tiers. Paid subscriptions are billed on a recurring basis (monthly or annually) as indicated at the time of purchase. Prices are displayed inclusive of applicable taxes.
We reserve the right to modify pricing with reasonable notice. Price changes will not affect your current billing period.
5. EU Right of Withdrawal
If you are a consumer in the European Union, you have a 14-day right of withdrawal from the date of purchase. You may cancel your subscription within this period without giving any reason and receive a full refund.
To exercise this right, contact us at [email protected] with a clear statement of your decision to withdraw. If you have actively used the service during the withdrawal period, we may charge a proportionate amount for the service already provided.
6. Intellectual Property
The SpecTrace platform, including its design, code, and branding, is the intellectual property of the Operator. Your telemetry and lap data remain your own. By using the service, you grant us a license to process and display your data within the platform (e.g., on leaderboards and session results).
7. Limitation of Liability
To the extent permitted by law, the Operator's liability is limited to the amount you have paid for the service in the 12 months preceding the event giving rise to the claim. The Operator is not liable for indirect, incidental, or consequential damages, including loss of data or interrupted access.
This limitation does not apply to damages caused by intentional misconduct or gross negligence, or where mandatory law provides otherwise.
8. Availability & Maintenance
We strive to keep SpecTrace available at all times but do not guarantee uninterrupted access. Scheduled maintenance or unforeseen technical issues may cause temporary downtime. We are not liable for any losses resulting from service interruptions.
9. Termination
You may terminate your account at any time by contacting us or through the application settings. Upon termination, your access to paid features will end at the close of the current billing period. We may retain certain data as required by law.
We may terminate or suspend your account if you violate these terms, with notice where practicable.
10. Governing Law & Dispute Resolution
These terms are governed by the laws of the Federal Republic of Germany. For consumers within the EU, mandatory consumer protection provisions of your country of residence apply where they offer greater protection.
The European Commission provides an online dispute resolution (ODR) platform at https://ec.europa.eu/consumers/odr. We are not obligated and generally not willing to participate in dispute resolution proceedings before a consumer arbitration board.
11. Changes to These Terms
We may update these terms from time to time. We will notify you of material changes by email or through the application. Continued use of the service after changes take effect constitutes acceptance of the updated terms.
